Welcome to Heavenly Portrait. By accessing or using our website and services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Services

Heavenly Portrait provides custom memorial portrait services. Our artists create custom portraits based on photographs you provide, depicting your loved ones in peaceful, heavenly scenes.

2. Orders and Payment

Placing an Order

When you place an order, you agree to provide accurate and complete information, including photographs suitable for creating your portrait. A 20% deposit is required at the time of order to begin work on your portrait.

Pricing

All prices are listed in US dollars. Prices include the portrait, framing, and free shipping within the United States. We reserve the right to change prices at any time, but changes will not affect orders already placed.

Payment Terms

We accept major credit cards and PayPal. A 20% deposit is due at order placement, with the remaining balance due after you approve your digital preview.

3. Portrait Creation Process

Timeline

• Digital preview: 3-5 business days after order placement
• Revisions: We offer unlimited revisions until you are satisfied
• Final portrait delivery: 5-7 business days after approval
• Express options are available for an additional fee

Preview and Approval

We will send you a digital preview of your portrait for approval before final creation. You may request revisions at no additional cost. Once you approve the preview, the portrait will be completed and shipped.

4. Photograph Requirements

For the best results, please provide:

• Clear, high-resolution photographs
• Images where the subject's face is clearly visible
• Photographs you have the right to use

You represent that you have the legal right to use any photographs submitted and that the photographs do not infringe on any third party's rights.

5. Intellectual Property

You retain ownership of the photographs you submit. Upon completion and full payment, you receive ownership of the physical portrait and a license to use digital images of the portrait for personal, non-commercial purposes. Heavenly Portrait retains the right to use anonymized versions of completed portraits in our portfolio and marketing materials unless you opt out.

6. Satisfaction Guarantee

We stand behind our work with a 100% satisfaction guarantee. If you are not completely satisfied with your portrait after reasonable revision attempts, we will provide a full refund. Refund requests must be made within 30 days of receiving your portrait.

7. Shipping and Delivery

Free standard shipping is included for all orders within the United States. We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control. Risk of loss passes to you upon delivery to the carrier.

8. Cancellations

You may cancel your order before the digital preview is created for a full refund of your deposit. Once work has begun on your portrait, cancellations may be subject to a partial refund based on work completed.

9. Limitation of Liability

To the maximum extent permitted by law, Heavenly Portrait shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid for your order.

10. Indemnification

You agree to indemnify and hold harmless Heavenly Portrait from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Harris County, Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified Terms.
